¿Qué significa convertirse en feminista? En este artículo intento analizar el feminismo como un proceso de subjetividad. Para articular el problema presento el Manifiesto de Oswald Andrade y la figura del caníbal, estableciendo un paralelismo entre la respuesta decolonial y la feminista contraria a la ontología política eurocéntrica, es decir, el modo en que entendemos la otredad desde Aristóteles. La construcción de los otros como monstruos representa un dispositivo específico de subjetivación que podríamos desactivar. Hacerlo implica desactivar la formación del (...) Uno en la propia subjetividad y hacer espacio para los otros en uno mismo. El enfoque poético de Andrade permite un pensamiento político de la comunidad dentro de la misma subjetividad debilitando el dualismo normativo entre lo individual y lo social, entre Uno y los otros de la metafísica tradicional. La tesis aquí es que un feminismo caníbal está llamado a desarrollar un modo diferente de hacerse a uno mismo y a la comunidad. (shrink)

The use of dispositions has been put into question many times in the philosophical literature, especially with regards to how dispositional attributions can be justified. Yet, dispositions are an important part not only of our everyday talk but also of our scientific practices. In this paper, we develop an argument that infers the epistemic justification of dispositional talk from itsindispensability for carrying out basic epistemological projects, and we apply it to the use of dispositions in evolutionary biology. For doing this, (...) we first advocate for a function-based strategy for the epistemic justification of dispositional attributions. We next review the functional role of some key dispositional notions in evolutionary biology, such as fitness and evolvability. Then, we show that alternative non-dispositional substitutes of these dispositions fail to fulfill their roles to the same degree. In Norms in the Wild, distinguished philosopher Cristina Bicchieri argues that when it comes to human behavior, social scientists place too much stress on rational deliberation. In fact, she says, many choices occur without much deliberation at all. Two people passing in a corridor automatically negotiate their shared space; cars at an intersection obey traffic signals; we choose clothing based on our instincts for what is considered appropriate. Bicchieri's theory of social norms accounts for these automatic components of coordination, (...) where individuals react automatically to cues that focus their attention on what the norm is in that situation. Social norms thus act as rules for making choices in a social world where people expect others -- often unconsciously -- to follow the same rule. Some norms enable seamless social co-operation, while others are less beneficial to human flourishing.Bicchieri is famous for her interdisciplinary work on game theory and most recently her work on social norms, and Norms in the Wild represents her latest challenge to many of the fundamental assumptions of the social sciences. Bicchieri's work has broad implications not only for understanding human behavior, but for changing it for better outcomes. People have a strongly conditioned preference for following social norms, but that also means that manipulating their expectations can cause major behavioral changes. Bicchieri has been working recently with UNICEF and other NGO's to explore the applicability of her views to issues of human rights around the world. Is it possible to change social expectations around forced marriage, genital mutilations, and public health practices like vaccinations and sanitation? If so, how? What tools might we use? This short book explores how social norms work, and how changing them - changing preferences, beliefs, and especially social expectations - can potentially improve lives all around the world. It will appeal to an unusually broad range of readers including philosophers, psychologists and others in behavioral sciences, and anyone involved in public policy or at NGOs. (shrink)

The New Evil Demon Problem presents a serious challenge to externalist theories of epistemic justification. In recent years, externalists have developed a number of strategies for responding to the problem. A popular line of response involves distinguishing between a belief’s being epistemically justified and a subject’s being epistemically blameless for holding it. The apparently problematic intuitions the New Evil Demon Problem elicits, proponents of this response claim, track the fact that the deceived subject is epistemically blameless for believing as she (...) does, not that she is justified for so believing. This general strategy—which I call the “unjustified-but-blameless maneuver”—is motivated, in part, by the assumption that the distinction between epistemic justification and blamelessness is merely an extension of the familiar distinction between moral justification and blamelessness. In this paper, I consider three ways of drawing the distinction between justification and blamelessness familiar from the moral domain: the first in terms of a connection with reactive attitudes, the second in terms of the distinction between wrongness and wronging, and the third in terms of reasons-responsiveness. All three ways of drawing the distinction, I argue, make it difficult to see how an analogous distinction in the epistemic domain could help externalists explain away the intuitions which underwrite the New Evil Demon Problem. Motivating the unjustified-but-blameless maneuver, I conclude, is a much less straightforward task than its proponents tend to assume. (shrink)

The public debate on climate change is filled with moral claims. However, scientific knowledge about the role that morality, ethics, and values play in this issue is still scarce. Starting from this research gap, we focus on corporations as central decision makers in modern society and analyze how they respond to societal demands to take responsibility for climate change. While relevant literature on business ethics and climate change either places a high premium on morality or presents a strong skeptical bias, (...) our sociological model depicts morality as an indeterminate force: it can lead to both workable solutions or merely reinforce the status quo, depending on what different corporations make of it. We describe, on the one side, the diffusion of moral values in the media discourse on climate change and, on the other side, the specific responses of corporations. While the media discourse generates a pressure on corporations to act responsibly, their moral claims do not provide clear advice for action. As a result, morality becomes available to organizations as a medium that can be re-specified according to their internal dynamics. Corporations transform moral values into something compatible with their own structures through a variety of different responses: introducing formal ethical structures (e.g., codes of conduct), initiating value-oriented projects, or developing informal moral norms, and so on. In some occurrences, morality becomes a mere façade, while in others it serves as a decision-making criterion and deeply influences core activities in firms. (shrink)

Many hypotheses have been advanced to explain the collective irrationality of COVID-19 vaccine hesitancy, such as partisanship and ideology, exposure to misinformation and conspiracy theories or the effectiveness of public messaging. This paper presents a complementary explanation to epistemic accounts of collective irrationality, focusing on the moral reasons underlying people’s decisions regarding vaccination. We argue that the moralization of COVID-19 risk mitigation measures contributed to the polarization of groups along moral values, which ultimately led to the emergence of collective irrational (...) behaviors. Collective irrationality arises from groups explicitly or implicitly endorsing values that ultimately harm both themselves and those around. The role of social media platforms in amplifying this polarization and contributing to the emergence of collective irrationality is also examined. Finally, potential strategies for addressing the moral sources of collective irrationality are discussed. (shrink)

We report the results of an experiment designed to determine the effects of psychological proximity—proxied by awareness of pain and friendship—on moral reasoning. Our study tests the hypotheses that a moral agent’s emphasis on justice decreases with proximity, while his/her emphasis on care increases. Our study further examines how personality, gender, and managerial status affect the importance of care and justice in moral reasoning. We find support for the main hypotheses. We also find that care should be split into two (...) components, one related to protection and the other to the preservation of relationships. Although gender does not affect moral reasoning directly, we find that it does so indirectly via personality, controlling for age, professional status, and professional background. We do not find a significant effect of managerial status on ethics of justice, but do find that holding a managerial position has a negative impact on ethics of care. Regarding personality, we detect significant positive effects of conscientiousness on ethics of justice and of neuroticism on ethics of care. (shrink)

This paper argues that hypocritical blame renders blame inappropriate. Someone should not express her blame if she is guilty of the same thing for which she is blaming others, in the absence of an admission of fault. In failing to blame herself for the same violations of norms she condemns in another, the hypocrite evinces important moral faults, which undermine her right to blame. The hypocrite refuses or culpably fails to admit her own mistakes, while at the same time demands (...) that others admit theirs. The paper argues that this lack of reciprocity—expecting others to take morality seriously by apologizing for their faults, without one doing the same in return—is what makes hypocritical blame unfair. In this study, we examine the relationship between appeal to self-perceptions of moral identity, included in the teaching of ethics, and the strengthening of moral judgment among postgraduate business students. As appeal to moral identity emphasizes personal engagement in the appraisal of an ethically charged situation, it addresses critiques of abstract rule application and principle transfer leveled at traditional business ethics teaching. Eighty-one participants completed a series of reflective writing exercises throughout a twelve-week business ethics unit. Based on an instrument (...) completed at the beginning and end of the education process, our results indicate a positive shift in moral judgement intensity. We, therefore, recommend appeal to moral identity as a leverage strategy to be employed in business ethics education in order to strengthen students’ moral judgment. (shrink)

In this new study, Cristina Chimisso explores the work of the French Philosopher of Science, Gaston Bachelard by situating it within French cultural life of the first half of the century. The book is introduced by a study - based on an analysis of portraits and literary representations - of how Bachelard's admirers transformed him into the mythical image of the Philosopher, the Patriarch and the 'Teacher of Happiness'. Such a projected image is contrasted with Bachelard's own conception of (...) philosophy and his personal pedagogical and moral ideas. This pedagogical orientation is a major feature of Bachelard's texts, and one which deepens our understanding of the main philosophical arguments. The primary thesis of the book is based on the examination of the French educational system of the time and of French philosophy taught in schools and conceived by contemporary philosophers. This approach also helps to explain Bachelard's reception of psychoanalysis and his mastery of modern literature. _Gaston Bachelard: Critic of Science and the Imagination_ thus allows for a new reading of Bachelard's body of work, whilst at the same time providing an insight into twentieth century French culture. In this paper I analyze the tension between realism and antirealism at the basis of Kantian constructivism. This tension generates a conflictive account of the source of the validity of social norms. On the one hand, the claim to moral objectivity characteristic of Kantian moral theories makes the validity of norms depend on realist assumptions concerning the existence of shared fundamental interests among all rational human beings. I illustrate this claim through a comparison of the approaches of Rawls, Habermas and (...) Scanlon. On the other hand, however, objections to moral realism motivate many Kantian constructivists to endorse the antirealist claim that reasonable agreement is the source of the validity of social norms. After analyzing the difficulties in the latter strategy, I try to show how a balance between the realist and antirealist elements of Kantian constructivism can be reached by drawing a sharper distinction between the justice and the legitimacy of social norms. How should citizens respond to dirty-hands acts? This issue has been neglected in the theoretical literature, which has focused on the dilemma facing the politician and not on the appropriate responses of citizens. Nevertheless, dirty-hands scenarios pose a serious dilemma for the democratic citizens as well: we cannot simply condone the dirtyhanded act but should instead express our moral condemnation and disapproval. One way of doing this is through blame and punishment. However, this proposal is unsatisfactory, as dirty-hands agents commit (...) wrongdoing through no fault of their own. I argue that we ought to make conceptual space for an idea of no-fault responsibility – and a corresponding notion of no-fault forgiveness – according to which we can hold agents to obligations without blaming them. The COVID-19 pandemic has exacerbated many social problems and put the already vulnerable, such as racial minorities, low-income communities, and older individuals, at an even greater risk than before. In this paper we focus on older adults’ well-being during the COVID-19 pandemic and show that the risk-mitigation measures presumed to protect them, alongside the generalization of an ageist public discourse, exacerbated the pre-existing marginalization of older adults, disproportionately affecting their well-being. This paper shows that states have duties to adopt and (...) put into practice redress measures to compensate for the negative consequences of COVID-19 public health policies on older adults’ overall well-being. These duties flow from the minimal ethical requirement of respect for persons. We show that respect is a morally basic attitude that presupposes taking the others’ interests into account, with the aim of advancing their well-being. This duty is not limited to kinship, relatives, and friends but it extends to states and the rest of the civil society. In the conclusion, we draw lessons from the COVID-19 pandemic and sketch some redress measures that could compensate for the decrease in older adults’ well-being as a result of the adoption of measures to contain the spread of the virus. Over the last half century, United States debates about abortion focused at first on the question whether the fetus is a person with rights and later on whether involuntary conception—for instance, as a consequence of sexual assault—might mitigate a woman’s responsibilities toward the fetus she carries. This article argues that, whatever one’s position on these two questions, a third, morally salient dimension of most US women’s experiences of unwanted pregnancy deserves more attention: both abortion and birth burden women with their (...) inevitable moral failure to fulfill their responsibilities to persons who frequently have de facto last‐resort and unavoidable claims on them. Using Lisa Tessman’s work on moral failure and Pope Francis’s interventions on abortion and mercy, I argue that this moral anguish is not a simple emotional remainder. Structural evil, not necessity, is the primary driver of forced pregnancy choices that injure women and their children both materially and morally. Consequently, whether they abort or carry to term, women with unwanted pregnancies need mercy or forgiveness. But they also need compassionate solidarity: prophetic, active efforts to transform the social structures that make material harm and moral failure, and consequent moral anguish and moral injury, inevitable for many pregnant women. Calisto and Melibea’s transgressive desire, and those who make (...) it possible, may be seen as directly contradicting moral and social laws upon which the tragicomedy claims to be predicated. Most of the characters in the work live their lives as transgression; their disorderly conduct leads inevitably to their death and destruction [Baranda 9]. The negative example offered by this work was, according to Maravall, what led early readers such as Quevedo to understand how the work: “debaxo del nombre de Comedia, enseña a vivir bien, moral y políticamente, acreditanto las virtudes y disfamando los vicios [under the title of Comedy, teaches one to live well, both moral and politically, accrediting virtues and discrediting vices]” [qtd. in Maravall 19].1 The Celestina lays bare its social and moralistic message by exposing the corruption of social and moral values prevalent in this late fifteenth-century work. Bringing together the aristocratic world of courtly love (already brought low through the Calisto’s crass treatment of waspish Melibea) and the bawdy world of the whorehouse, Rojas debases the people and passions therein. Connecting both worlds through her comings and goings is Celestina. Characterized as abeja, a political animal used in the Middle Ages and early modern period that informs the ideal structure of society, Celestina exposes a satire of society and its corruption of moral values.As the Síguese and prologue indicate, the tragicomedy was written with a dual and moral intent. The author wrote to disabuse the many “galanes y enamorados mancebos [handsome young men and enamored youth]” of his country from the cruel and evil fires of love, but also to expose “engaños de las alcahuetas y malos y lisonjeros siruientes [the deceptions of procuresses and evil sycophantic servants].” In the Celestina, the deceits of the bawd and servants Sempronio and (later) Pármeno complicate the narrative and move it to its tragic conclusion. As Celestina and Sempronio set out to profit by Calisto’s lovesickness, they are met with opposition from Pármeno. The initial resistance Pármeno puts up to defend himself and his master from the economic lust felt by Celestina and Sempronio serves to expose a conflict in social class. The heedless attainment of wealth demonstrated by the servants contradicts a more aristocratic principle that was perceived to guide economic thought in the Middle Ages [Maravall 60]. Celestina’s spoken adage, “[a] tuerto o a derecho, nuestra casa hasta el techo [by hook or by crook, our house [End Page 147] through the roof],” exposes her unmitigated greed and contrasts sharply with Calisto’s more courtly (if yet parodic) examples of largesse. The alcahueta’s greed is not merely opportunistic, it belies a certain Schadenfreude felt for Calisto’s woes. Like “cirurjanos [ante] los descalabrados [surgeons before patients with head trauma],” Celestina pursues Calisto in search of money, which at this particular moment in history was slipping through the hands of her real-life counterparts and into those of state-appointed brothel keepers. As Lacarra notes, the granting of royal mercedes for the incomes derived from prostitution to royal towns or notable persons became prevalent during the reign of Ferdinand and Isabel [40]. One must imagine women such as Celestina doubly feeling the pinch from this seemingly “catholic” imposition. Income from the alcahueta livelihood from all of Castile certainly must have been dwindling. At the same time, the alcahueta’s dishonest way of living was being usurped by speciously honorable citizens who no doubt maligned the prostitutes on whom their wealth was gained. Despite the growing danger of her increasingly clandestine profession, Celestina shows little shame or fear. Indeed, her sense of “honor” for the putería is so brightly and enthusiastically expressed in the work bearing her name that one wonders if it might not stem from... (shrink)

I start by presenting an intuitively appealing account of forgiveness, ‘the insult account’, which nicely explains the cycle from wrongdoing to forgiveness. We need to respond to wrongdoing by blaming our offenders because they insult us with their actions, 529–55, 2001; Hampton 1988a, b). How can wrongdoing be overcome? Either by the retraction of the insult or by taking necessary steps to correct for the wrong done. Once the insult has been retracted, usually by apology or remorse, forgiveness can come (...) about. Martin The Journal of Philosophy, 107, 534–53, has recently criticized this promising account of forgiveness. My aim here is to defend an improved version of the ‘insult account’. I propose an account of earned forgiveness through apology, which shares features with the ‘insult account’ criticized by Martin, but also improves upon problems found in the ‘insult account’. This new account will successfully solve the puzzle of forgiveness. Drawing on Bovens’ account of apologies, I argue that apologies uniquely earn the wrongdoer’s forgiveness. I finally address a concern about the relation between apologies and forgiveness, recently raised by Hallich Ethical Theory and Moral Practice, 16, 999–1017,. I argue that my expressive view of what the function of apologies is will answer his skepticism about apologies. (shrink)

In this paper we introduce the concept of attentional scaffolds and show the resemblance between social media platforms and slot machines, both functioning as hostile attentional scaffolds. The first section establishes the groundwork for the concept of attentional scaffolds and draws parallels to the mechanics of slot machines, to argue that social media platforms aim to capture users’ attention to maximize engagement through a system of intermittent rewards. The second section shifts focus to the interplay between emotions and attention, revealing (...) how online attentional capture through emotionally triggering stimuli leads to distraction. The final section elucidates the collective implications of scaffolding attention through social media platforms. The examination of phenomena such as emotional contagion and the emergence of group emotions underscores the transition from individual experiences to shared collective outcomes. Employing online moral outrage as a case study, we illustrate how negative emotions serve as scaffolds for individuals’ attention, propagate within social groups, and give rise to collective attitudes. CHILDREN ARE INCONSISTENTLY LABELED MORAL AGENTS IN SOME HIGHLY charged situations and denied that status in others. This essay draws on the writings of Nomy Arpaly, Lisa Tessman, and legal theorists to argue that both children and adults should nearly always be considered moral agents. But agency does not imply autonomy, ability to articulate rational reasons, or legal liability for either adults or children. Rather, all agents are dependent and conditioned. This quality divides them from a strict Augustinian vision in (...) which adults and children are fully and solely responsible for their actions. The subtext of Augustine's Confessions suggests that Augustine's biography can as easily be interpreted according to the present framework as according to his own thematic of concupiscence. (shrink)

En el siguiente ensayo se reflexiona en torno a la propuesta de Emmanuel Levinas y su concepción de ética de la alteridad como un puente para enlazar con La ética de la Tierra, planteada por Aldo Leopold y así evolucionar el objeto de la ética de una alteridad que se refiere “al otro” para referirse a “lo otro” y poder hacer de los seres no humanos un objeto de obligaciones morales.

This paper examines whether appealing to learners’ moral identity makes a significant contribution to improving their ethical decision making beyond traditional, rule-based teaching. In response to criticisms leveled at rule-based ethics teaching by alternative approaches, we identify moral identity theory and experiments in moral psychology as useful sources to draw on for the creation of a new, identity-based ethics teaching approach. We develop and apply a set of regular self-reflection focused writing tasks added to the traditional teaching program over a (...) one-semester period, and assess the outcomes of an overall sample of 149 postgraduate business school students, who were randomly assigned to one of three conditions: exposure to both identity-based tasks and rule-based teaching, exposure to rule-based teaching only, and the control condition. Our findings show that, while the three groups reported the same level of ethical decision making at the beginning of the semester, at the end of the semester the students who were exposed to both identity-based and rule-based teaching reported higher level of ethical decision making compared to those who were only exposed to rule-based education. In addition, the students who received rule-based teaching reported higher ethical decision making compared to those in the control condition. These results suggest that a teaching approach which appeals to the learner’s moral identity can act as an effective leverage point when complementing rule-based teaching. This simple approach should be widely adopted as common practice in graduate business schools. (shrink)

Bachelard regarded the scientific changes that took place in the early twentieth century as the beginning of a new era, not only for science, but also for philosophy. For him, the theory of relativity and quantum mechanics had shown that a new philosophical ontology and a new epistemology were required. I show that the type of philosophy with which he was more closely associated, in particular that of Léon Brunschvicg, offered to him a crucial starting point. Brunschvicg never considered scientific (...) objects as independent of the mind, and as a consequence questions such as the existence of particles independently of the mind, theory or apparatus, were absent from his philosophy, which was rather aimed at analyzing the mind critically, and above all historically. Bachelard accepted the fundamental ideas of Brunschvicg’s philosophy; however, his own reading of contemporary science enabled him to go beyond it, as shown by his emphasis on the social production of knowledge, and by his removal of the distinction between ideas and technologically produced objects of knowledge. For him, modern science teaches philosophy that knowledge is not a phenomenology but rather a ‘phenomenotechnique’. Philosophers have proposed accounts of forgiveness in which the victim is warranted in forgiving only if the wrongdoer makes amends for the wrong done. According to such an account, forgiveness is made rational by the wrongdoer apologizing. But this account creates a puzzle because it seems to render cases of undeserved elective forgiveness (where there is no apology or repentance) unjustified. My aim in the present contribution is to argue that electively forgiving unrepentant wrongdoers can be justified if we accept (...) as genuine a minimalist form of forgiveness, according to which a victim can forgive and still resent. Further, I suggest that undeserved elective forgiveness can be admirable if we extend our conception of reasons to include non- desert-type reasons, such as reasons of altruism, generosity or reasons of social context. En este artículo se argumenta contra la interpretación metaética del kantianismo moral como una forma de constructivismo o antirealismo moral. Dado que los kantianos no comparten el expresivismo característico del antirealismo moral estándar, el constructivismo kantiano parece llevar a una posición inherentemente inestable que sólo puede desarrollarse o bien en un realismo consistente con el cognitivismo moral kantiano o en un decidido antirealismo moral. Tomando la ética del discurso de Habermas como ejemplo, aquí se contrasta una interpretación realista con una (...) interpretación antirealista del principio moral de universalización con la intención de mostrar que sólo la primera es compatible con el cognitivismo moral característico de las éticas kantianas, mientras que la segunda lleva inevitablemente a un planteamiento decisionista y, con ello, a un claro relativismo moral. Moral outrage is often characterized as a corrosive emotion, but it can also inspire collective action. In this article we aim to deepen our understanding of the dual nature of online moral outrage which divides people and contributes to inclusivist moral reform. We argue that the specifics of violating different types of moral norms will influence the effects of moral outrage: moral outrage against violating harm-based norms is less antagonistic than moral outrage against violating loyalty and purity/identity norms. We identify (...) which features of social media platforms shape our moral lives. Connectivity, omniculturalism, online exposure, increased group identification and fostering what we call “expressionist experiences”, all change how moral outrage is expressed in the digital realm. Finally, we propose changing the design of social media platforms and raise the issue of moral disillusion when ample moral protest in the online environment does not have the expected effects on the offline world. How do socially imposed rules develop into internalized pro-social codes? In the article “From Bodo Ethics to Distributive Justice”, Russell Hardin discusses one of the central themes of his work: How we “export” social order from a small, insular community to a large, anonymous society. In Bodo’s small village, everyone knows everyone else, interactions are face-to-face, and people live relatively isolated from other communities. In this context, the social norms developed by the community are easily enforceable. But what about large, (...) anonymous societies, where monitoring is difficult and costly and sanctioning transgressions carries a greater risk? When unobserved, only someone with an inner motivation to behave in a socially beneficial way will continue to obey the informal rules. How such an inner motivation develops is a topic of debate in moral philosophy and psychology, especially whether pro-social decisions are a matter of rationality or are driven by emotions. This paper asks how to account for vulnerable integrity in the temporal dynamism of human lives without relying on a subtractive vision of integral human nature, borrowing from presumed past or future rationality and maturity, or depending on an external attribution of dignity. Illustrating the challenges with vignettes from the author’s life, it argues inductively that human integrity includes morally inviolable vulnerability to others with whom we are in interdependent relationship and without whom we cannot develop or maintain our selves. (...) Others reside at the core of our integrity, for better and for worse, and we reside at theirs. Augustine’s accounts of memory, time, and the narrative self; Whiteheadian process thought’s understanding of continuity through change; and feminist theories of narrative all provide theological and philosophical justifications for this vision of integrity. John Wall’s and Johan Brännmark’s non-foundational approaches to integrity and human rights lead us to the same conclusion without entailing theological anthropological claims, ensuring its relevance in a pluralist culture. Adults typically take pleasure in the physical dimension of caring for children. Confusingly, much recent theology either condemns adults' physical enjoyment of children as exploitive or accepts it without comment. A convincing, unifying theological moral argument is needed to yoke the two instincts systematically. Although this essay acknowledges sexual abuse's harmful effects on children, its focus is the ordering of adult desire and behavior. Beginning from the premise that all human love is erotic—hoping in, if not expecting, pleasurable reciprocity—I draw (...) upon the work of Wendy Farley and Linda Holler to argue that healthy human love for children combines desires for the other with unpossessive delight, attunement, and realistic responsiveness. I examine the documented examples of female abuse of children and the example of male abuse in Vladimir Nabokov's Lolita to demonstrate the usefulness of this discussion for an analysis of Western accounts of abuse, and I suggest that the approach may be illuminating in other cultures. AGAINST THE BACKGROUND OF THE NEAR-PROHIBITION OF TOUCH IN RElations between unequals, this essay addresses very different questions: When do more-powerful people owe touch to less-powerful people as a consequence of their moral responsibility to care and nurture? How are we to understand morally the enjoyment that powerful adults receive from such contacts with their charges? This essay draws on psychological literature on touch to argue that touch is a condition of human flourishing. Consequently, in many circumstances the obligation to (...) care not only permits but requires physical affection. It argues as well that the lines separating required, permitted, and forbidden touch are somewhat culture-dependent but nevertheless can be adjudicated. Finally, it suggests how traditional theologies and ethics of embodiment might support and be developed by these claims, showing that a positive ethic of touch shares the same theological foundations as the existing ethic of protection. The first part of this article is about the rules that define a legal order’s supreme legislative authority. In this first part, the article also dwells on several distinctions such as those between norms and meta-norms, legislative and customary rules, and constitutive and regulative rules, all with the objective of determining which of these categories the aforementioned rules belong to. The conclusion is that the basic rules defining the supreme legislative authorities of every existing legal order are necessarily constitutive meta-norms (...) and have a customary nature. The second part of this article takes into account the different possible contents of the ultimate rules that define legislative authority. On this basis, four models of legal order and legislative authority are distinguished: those corresponding to absolute authority and to moral authority, and those corresponding to the rule-of-law state and to the constitutional state. In this regard, several considerations are offered that, on the one hand, single out the specific notion of authority accepted within the constitutional state and, on the other, offer a specific critique of the theoretical distinction between constitutive and constituted authority. According to the analysis provided in this article, every authority is a constituted authority. In particular, supreme legislative authorities are constituted by customary constitutive norms that fall beyond the reach of the authorities themselves and do not depend on the decision or will of any particular individual. In his book The Future of Human Nature, Habermas argues against the moral and legal permissibility of any future practices of genetic human enhancement as well as against current practices such as embryonic research or preimplantation genetic diagnosis. After analyzing the core of Habermas’s argument against positive eugenics, I argue that his attempt to derive a principle of abstention under uncertainty from the principle of counterfactual consent assumes that non-interference is the proper default norm in the absence of consent. Yet, (...) this cannot be a plausible default norm for parental relationships. Moreover, since Habermas agrees that the no-harm principle justifies negative eugenics, once technical possibilities of genetic manipulation become available, non-interference becomes as much in need of normative justification as interference. I conclude that if our normative innocence regarding positive eugenics must be lost for the sake of negative eugenics, then it is an innocence well lost. (shrink)

In a recent article Allan Buchanan and Robert Keohane defend the view that one of the necessary conditions for the legitimacy of global governance institutions such as the WTO and the IMF is that they respect basic human rights. I certainly agree that setting the minimal threshold of moral acceptability any lower would be entirely unreasonable. But, unfortunately, the view that global governance institutions have human rights obligations is far from uncontroversial. These institutions themselves go to great lengths to deny (...) such a claim. Their official stance finds strong normative support in the state-centric conception of human rights that dominates both normative debates about human rights and current human rights practice. In this article I challenge some of the normative assumptions behind the state-centric conception in order to defend a pluralist conception that ascribes human rights obligations not only to states but also to non-state actors such as global governance institutions. After briefly analyzing some of the proposals currently under discussion about how to legally entrench the obligation to respect human rights in those institutions, I will defend the feasibility of those proposals against the objection that their implementation is incompatible with the current state-system and thus it would require the creation of a world state. With AI permeating our lives, there is widespread concern regarding the proper framework needed to morally assess and regulate it. This has given rise to many attempts to devise ethical guidelines that infuse guidance for both AI development and deployment. Our main concern is that, instead of a genuine ethical interest for AI, we are witnessing moral diplomacies resulting in moral bureaucracies battling for moral supremacy and political domination. After providing a short overview of what we term ‘ethics washing’ in (...) the AI industry, we analyze the 2021 UNESCO Intergovernmental Meeting of Experts (Category II) tasked with drafting the Recommendation on the Ethics of Artificial Intelligence and show why the term ‘moral diplomacy’ is better suited to explain what is happening in the field of the ethics of AI. :Recent behavioral economics studies have shown that third parties compensate players in Dictator, Ultimatum, and Trust games. However, there are almost no studies about what drives third parties to compensate victims in such games. It can be argued that compensation is a form of helping; and helping behavior, in a variety of forms, has been widely researched, especially with regard to motivators. Previous work on helping behavior has focused on empathic concern as a primary driver. In sharp contrast, anger is (...) often seen as an antisocial motivator resulting in aggression. However, other research has shown that moral outrage, anger evoked by the violation of a moral rule or a social norm, can lead to the punishment of a perpetrator, often described as altruistic or pro-social punishment. Some of the motivations for pro-social punishment, namely a concern for justice or the restoration of community values, can also be realized through victim compensation. We therefore propose the hypothesis that moral outrage leads to compensating behavior above and beyond what is predicted by empathic concern, but only when a social norm has been violated. We test this hypothesis in two studies, both of which use modified trust games in which the investor experiences a loss due either to a social norm violation or some other cause. Study 1 shows that trait moral outrage predicts third-party compensatory behavior above and beyond empathic concern, but only when a social norm is violated. To better understand the causal mechanism, Study 2 directly manipulated moral outrage, showing again that moral outrage leads to compensation, but only when a social norm is violated. InA Theory of Justice, Rawls claims that “to each according to his threat advantage is not a conception of justice.” Although it may indeed seem intuitively plausible that a principle based on “threat advantage” cannot count as a principle of justice, it is an altogether different matter to explain why this is so. The question is especially pressing if one bears in mind that such a principle of bargaining in fact underlies many institutionally regulated interactions. Moreover, to the extent that (...) morality is thought of as a mechanism for guaranteeing mutual advantage in the resolution of conflicts, it may indeed seem necessary that it reflect the bargaining power of the parties (in order to make sure that it is indeed advantageous for all of them). In fact, there is a prominent tradition of social-contract theories (from Hobbes to Gauthier) that work under this assumption and claim to provide an answer to what justice requires as much as Rawls's theory does. So seen, the burden of proof seems to fall rather on the shoulders of those committed to claim both that morality is a mechanism that works to the advantage of all and that it nevertheless requires neutralizing all differences in bargaining power. The future rests under the sign of technology. Given the prevalence of technological neutrality and inevitabilism, most conceptualizations of the future tend to ignore moral problems. In this paper we argue that every choice about future technologies is a moral choice and even the most technology-dominated scenarios of the future are, in fact, moral provocations we have to imagine solutions to. We begin by explaining the intricate connection between morality and the future. After a short excursion into the history of (...) Artificial Intelligence, we analyse two possible scenarios, which show that building the future with technology is, first and foremost, a moral endeavor. (shrink)

In a time marked by the development of innovative treatments in healthcare and the need for health professionals to deal with resulting ethical dilemmas in clinical practice, this study was developed to determine the influence of the bioethics teaching on the moral competence of medical and nursing students. The authors conduct a longitudinal study using the Moral Competence Test extended version before and after attending the ethics curricular unit, in three nursing schools and three medical schools of Portugal. In this (...) questionnaire the participant is confronted with three ethical dilemmas and asked to evaluate arguments for and against the attitude of the main character. For both nursing and medical students, C-score was lower after the attendance of the ethics curricular units, with a statistically significant decrease in the total score for nursing students and a decrease not statistically significant for medical students. A multivariate analysis did not find any association between this decrease and gender, course, or age. The phenomenon of moral segmentation was observed, with better performance in the worker and judge dilemma, than in the doctor dilemma. These results highlight the need to reflect on the curricular strategies that can be implemented for health professionals to better develop moral competence and decision-making, allowing for the provision of humanized health care. During the last decade there has been burgeoning research concerning the ways in which we should think of and apply the concept of responsibility for Artificial Intelligence. Despite this conceptual richness, there is still a lack of consensus regarding what Responsible AI entails on both conceptual and practical levels. The aim of this paper is to connect the ethical dimension of responsibility in Responsible AI with Aristotelian virtue ethics, where notions of context and dianoetic virtues play a grounding role for (...) the concept of moral responsibility. The paper starts by highlighting the important difficulties in assigning responsibility to either technologies themselves or to their developers. Top-down and bottom-up approaches to moral responsibility are then contrasted, as we explore how they could inform debates about Responsible AI. We highlight the limits of the former ethical approaches and build the case for classical Aristotelian virtue ethics. We show that two building blocks of Aristotle’s ethics, dianoetic virtues and the context of actions, although largely ignored in the literature, can shed light on how we could think of moral responsibility for both AI and humans. We end by exploring the practical implications of this particular understanding of moral responsibility along the triadic dimensions of ethics by design, ethics in design and ethics for designers. En una primera parte analiza desde diversas perspectivas las críticas cada vez más fuertes a las teorías éticas imparcialistas y universalistas, que han suscitado a su vez el renacimiento del tratamiento de la amistad como fenómeno moral; dicho análisis pretende también llamar la atención sobre diversos puntos críticos de las llamadas teorías de la amistad. En una segunda parte se analiza el modelo aristotélico (...) de las amistades virtuosas, mostrando la estructura de este tipo de amistad y su relación con la ética, para resaltar así algunos puntos de la teoría aristotélica de la amistad que pueden ser de ayuda para una mejor comprensión del problema hoy en día.
